In a landmark verdict, the Supreme Court of Nigeria has upheld the election victory of Peter Mbah, the candidate of the Peoples Democratic Party (PDP), in the Enugu State governorship election held in March 2023. The apex court firmly dismissed the appeal brought forth by Uche Nnaji, the governorship candidate of the All Progressives Congress (APC), challenging Mbah’s win.
Justice Tijani Abubakar, presiding over the judgment, emphasized the critical nature of the legal process and ruled that the legal team representing the APC and Nnaji had submitted an invalid brief of argument. Furthermore, they failed to provide convincing reasons to sway the court in favor of allowing the appellants’ incompetent brief.
Justice Abubakar went on to clarify that the invalidity of the brief also extended to the appeal itself, rendering it untenable. Consequently, the Justice dismissed both the brief and the appeal presented by Nnaji and the APC, solidifying Peter Mbah’s victory in the Enugu State governorship election.
